Calfee Insurance Coverage Practice attorney Tae Andrews was quoted in the January 1, 2025, Law360 Insurance Authority article “The Top Property Insurance Decisions of 2024.” In the article, reporter Eli Flesch speaks with several insurance attorneys to provide an overview of the 2024 property insurance decisions that industry practitioners viewed as the most significant.
Tae commented on a Colorado Supreme Court decision in March that a rule “excusing some policyholders for filing late claims applies to occurrence-based, first-party homeowners’ property policies, a determination the experts said could help homeowners in the wake of natural disasters.”
Quoting the article, “Tae Andrews … said what’s fair about the Colorado decision is that it recognizes that the notice deadline in occurrence policies are not fundamental or material terms of the contract. He said homeowners in particular, who aren’t sophisticated businesses, would benefit greatly.”
Tae stated, “To allow the insurers to rely on these sort of ‘gotcha’ technicalities of late notice to try to avoid paying otherwise covered claims is unfair.”
