James F. (Jim) Lang, Litigation Partner and Co-Chair of Calfee's Energy and Utilities practice, was quoted in a Law360 article titled "Ohio Justices Nix Use Tax on Co.'s Commercial Waste Trucks" by Abraham Gross (April 22, 2021).
In an opinion signed by five of seven justices, the Ohio Supreme Court ruled in favor of Jim Lang's client, NAT Transportation, Inc., finding that a "for-hire motor carrier's purchases of trucks used to haul commercial and industrial waste qualify for a use-tax exemption, partially reversing a state Board of Tax Appeals decision." Jim, who serves as lead counsel for NAT Transportation, told Law360 that this case was important because the trucks are fairly expensive and the tax exemption may apply to each truck purchased to haul waste. Other for-hire transportation companies hauling waste in Ohio may now be able to take advantage of the tax exemption if their customer contacts satisfy the Court's test.
