Mark focuses on securing and enforcing intellectual property rights for both large and small businesses. A substantial portion of his practice is devoted to patent procurement, counseling and litigation matters.
Mark regularly counsels clients on the enforcement and defense of intellectual property rights. His litigation experience includes handling patent, trademark, copyright, trade secret, unfair competition and contract claims on behalf of both plaintiffs and defendants. He has experience in both state and federal court, including all facets of district court litigation and appeals to the Federal Circuit. Mark has also handled numerous inter partes review proceedings before the Patent Trial and Appeal Board. On behalf of petitioners, Mark has secured multiple decisions finding the claims of the patent unpatentable. He has also obtained decisions denying institution of an inter partes review for multiple patent owners.
Mark works closely with clients to find creative solutions to their intellectual property related issues. He is often called upon to counsel on patent clearance and due diligence matters, including patent portfolio analyses, validity and infringement opinions. Mark also works with clients to strengthen their intellectual property positions for product lines and build the overall value of their portfolio.
Mark further provides counsel and strategy to clients on the procurement of intellectual property rights. He prepares and prosecutes patent applications on a diverse range of innovations in areas such as industrial and consumer products, electrical devices, building materials, medical devices and equipment, automotive and computer related technologies. Mark has also developed significant experience in the area of design law. He works with clients to manage their worldwide patent portfolios and has experience with complex prosecution matters such as reexamination proceedings.
Mark received his law degree, cum laude, from Case Western Reserve University with honors in his concentration of law and technology. He participated in the Journal of International Law, the Intellectual Property Entrepreneurship Clinic and received the ABA/BNA Award for Excellence in the Study of Intellectual Property. Mark enjoys lecturing on a variety of intellectual property topics, including the America Invents Act, and has been named a “Rising Star” by Ohio Super Lawyers.
Mark’s professional background includes working as a mechanical engineer for General Motors Corp. and as a technology consultant assisting clients in the banking and insurance industries at Accenture Ltd. He joined Calfee in 2006 and became a partner in 2015.
